Mattamy Homes SMS Privacy Policy

This Mattamy Homes SMS Privacy Policy (the “Policy”) governs how Mattamy Homes Limited (Canada) and Calben (US) Corporation (USA) (collectively, “Mattamy”, “we”, “us”, “our”) treats Your Personal Information  (as defined below) that we collect and receive from you in connection with your use of the SMS service (the "Service").

The Service is made available to you through a third-party service provider. We currently use TrueDialog Inc. (“TrueDialog”) to provide the Service, but we retain the discretion to add or replace this or any other service provider at any time.  

This Policy focuses on how we specifically collect, use, share and manage Your Personal Information in connection with the SMS Service.  For information regarding Mattamy’s general personal information handling practices, please see our Privacy Policy.

 

WHAT DOES THE SERVICE DO?

Mattamy offers the Service to allow you (the "User") to receive SMS mobile messages by affirmatively opting into the Service (as described below under COLLECTION OF INFORMATION). By participating in the Service, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number and/or e-mail address associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of Mattamy's mobile messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer").

 

COLLECTION OF INFORMATION

We collect your full name, phone numbers, information about the Mattamy communities that are of interest to you, and your SMS opt-in or consent status (collectively, “Registration Information”) when you sign-up for the Service on our website lead form and follow the instructions to complete enrollment in the Service, or when you otherwise opt-in to receive SMS messages. We collect this information only when you voluntarily provide it to us.

 

In addition, Mattamy or its service provider collects data about our SMS campaigns and your interactions with them (collectively, “Campaign Data” and together with the Registration Information, “Your Personal Information”). For example, we track what SMS messages are sent to you, and whether you respond to them or interact with them (such as by clicking on a link in the message).

 

We may also request other information when you sign-up to connect with our team (e.g., email address), but that information is used to communicate with you via means other than SMS, and so it is not covered by this Policy. You can review our Privacy Policy for information on how we use such other information.

 

USE  & SHARING OF PERSONAL INFORMATION FOR THE SMS SERVICE 

Your Registration Information is used in connection with the Service to provide you with personalized  messages, updates, and promotional offers via SMS. These SMS messages and notifications may relate to our products, services, updates, or discounts that we think may interest you, including based on your communities of interest. SMS messaging charges may be applied by your carrier.

 

Campaign Data is used to evaluate and generate reports about the SMS messages that we send out, including the success of our marketing campaigns and how users are responding to our messages or otherwise using the Service.

 

We do not generally share Your Personal Information with any third party for purposes unrelated to providing you with the Service. However, we may share this information when we are required or permitted to do so under applicable laws. For example, Your Personal Information may be shared with law enforcement to investigate or prosecute a potential violation of law. Please see our general Privacy Policy for more information about circumstances when we may be permitted or required by law to share your information with a third party.

 

We may also share your Personal Information with third parties that help us provide the Service. This includes  our main service provider for the Service (currently TrueDialog) and participating carriers as listed in the Mattamy Homes Limited SMS Terms of Service.  We may add to or change our service providers and carriers from time-to-time, in our discretion. Please note that our service providers and carriers may transfer or store your information outside the country where you are located, in which case the information may be accessible to courts, law enforcement and national authorities in other countries.

 

Your Personal Information will not be shared with third parties or our affiliates for their own marketing/promotional purposes if such information is provided to us solely for the purpose of providing the Service.  Please note, however, that nothing in this Policy is intended to impact our sharing of your personal information, with your consent (express or implied, as permitted by law), outside the context of the Service, as described in other applicable privacy notices and policies.

 

Once you have opted out of the Service (as described below), other than an additional mobile message confirming your decision to opt out, we will not send you any more SMS messages (unless you opt back in).

 

SMS MESSAGING

As a result of opting-in to the Service, you may receive SMS Messages at any time of day, from 12:00 a.m. to 11:59 p.m., on any given day, without regard to your local time zone. You expressly understand and acknowledge it is imperative that your Registration Information is entered correctly to receive messages from Mattamy. OPTING OUT OF SMS

If at any time you wish to stop receiving SMS messages and notifications from us, you can withdraw your consent to our use of your phone number for this purpose by texting STOP, END, CANCEL, UNSUBSCRIBE, STOPALL, REVOKE, OPT-OUT, or QUIT in reply to any SMS message that you receive from Mattamy.

 

You will receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are reasonable methods of opting out. You understand that the Service may not recognize and respond to unsubscribe requests that contain words or phrases other than those set forth above, and Mattamy, its service providers, and carriers will have no liability for failing to honor such requests.

 

YOUR CHOICES

Signing up for the Service is entirely optional. You do not need to sign up for SMS messages and notifications to receive information about current promotions. For example, you may instead choose to receive this information via email. As described above, you can also choose to opt-out of SMS messages at any time.   

 

CHANGES TO THIS POLICY

We may periodically update this Policy. We will notify you about significant changes in the way we treat your Personal Information by placing a prominent notice on our site or by sending an SMS message to you. Where required by law, we may request your consent to such changes (e.g., if we want to use or share your information for a new purpose).

Our service providers may process and store your personal information in the United States. You may contact our Privacy Officer, as described in our general Privacy Policy, if you have questions about the collection, use, disclosure or storage of personal information by our service providers outside Canada, or wish to obtain access to written information about our policies and practices with respect to such service providers.
