Mattamy Homes SMS Terms of Service

  1. You acknowledge by entering your full name, phone number and checking the box (the "Registration Information") you expressly agree to receive recurring automated text messages (such as SMS, MMS, or successor protocols or technologies) and notifications from Mattamy Homes Limited (Canada) and Calben (US) Corporation (USA) (collectively, “Mattamy”, “us”, “we”, “our”) concerning your relationship with us and any of our products, services, promotional offers, and transactions that we think may interest you (this is the "Service"). Your consent can be withdrawn at any time. You understand that consent is not required to make any purchase from us, and your consent to receive messages and notifications is not a requirement to use our Website or any of our services. Message and data rates may apply. Message frequency varies.

  2. By agreeing to receive text messages and notifications from us, you consent to us creating an electronic record to document this agreement.

  3. You can cancel this service and revoke your consent at any time. Just text STOP, END, CANCEL, UNSUBSCRIBE, STOPALL, REVOKE, OPT-OUT, or QUIT in reply to any text message that you receive from Mattamy. After you send the message to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages or notifications from us. The Service may not recognize and respond to unsubscribe requests that contain words or phrases other than those set forth above. Mattamy, its service providers, and carriers will have no liability for failing to honor such requests.

 

  If you want to join again, just sign up as you did the first time, and we will start sending messages and notifications to you again.

 

  1. If at any time you forget what keywords are supported, just text "HELP"  in reply to any text message that you receive from Mattamy. (Canada). After you send the message "HELP" to us, we will respond with instructions on how to use the Service as well as how to unsubscribe.

  2. Participating carriers:

a. Our current participating carriers in the United States are: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central, IL (ECIT), Cellular One of Northeast Pennsylvania, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

b. Our current participating carriers in Canada are: Rogers Wireless, Telus Mobility, Bell Mobility, and Quebecor.

c. Participating carriers may be changed at Mattamy's sole discretion without prior notice.

 

  1. Depending on your current carrier plan, you may incur charges for these messages and notifications.  You agree not to hold Mattamy, its service providers and all carriers liable for any charges and agree that Mattamy, its service providers and all carriers are not liable for delayed or undelivered messages. You agree to indemnify Mattamy, its service providers and all carriers for any privacy, tort, or other claims, including claims under the United States Federal Telephone Consumer Protection Act or state law equivalents, the Telecommunications Act (Canada), An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act (Canada), including claims relating to your voluntary provision of a telephone number that is not owned by you and/or your failure to notify us of any changes in your mobile telephone number.  You agree to indemnify, defend and hold us harmless from and against any and all such claims, losses, liability, costs and expenses (including reasonable attorney's fees).

  2. Mattamy requires that users of the Service be limited to US residents in markets where we operate and persons in Canada who are located in Ontario and Alberta.

  3. You expressly understand and consent to receipt of SMS Messages at any time of day, from 12:00 a.m. to 11:59 p.m., on any given day, without regard to your local time zone. You expressly understand and acknowledge it is imperative that your Registration Information is entered correctly to receive messages from Mattamy.

  4. As always, message and data rates may apply for any messages or notifications sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
