Please note that this Privacy Notice is not intended to apply to the Mattamy Portal that is provided to customers in order to allow them to access resources, information and documentation related to their home purchase, community development, and ongoing relationship with Mattamy. When we refer to “you” or “your,” we mean the person using Mattamy's Website and Services as defined below. Mattamy takes privacy seriously. The purpose of this Privacy Notice is to inform you of how Mattamy and its family of affiliated companies (excluding Mattamy Home Funding, LLC®) may collect, use, and share your personal information when you purchase a home, use one of our websites ("Website") and any other services we offer (collectively, the "Services"), and otherwise interact with us (except via the Mattamy Portal, which has its own privacy policy). This Privacy Notice also describes your choices about the collection and use of your information.

Occasionally, we need to share some information about you with third parties (such as lenders, legal counsel, telecommunications companies, utilities, insurance companies, Tarion, regulatory authorities, etc.), affiliates and a variety of service providers to complete transactions with you.  This is done as required to ensure that you receive what you paid for.  Outside of information we share with vendors to complete transactions with you, we may also share your interactions with our website with the vendors that help us understand how you and others interact with our website, and may use that to help improve the functionality, or provide you with relevant advertising on and off of our website.  We may also share your information with vendors and social media sites that provide marketing services to us. HOW DOES MATTAMY COLLECT YOUR INFORMATION?

When you visit a sales center, purchase a home, use our website or other Services, or otherwise interact with us, we may collect and use personal information (i.e. information that identifies you, or may reasonably be associated with you). This personal information may include information you voluntarily provide to us such as your name, email address, telephone number, home or other physical address, and other categories of personal information we set out below.

 

  • Registration/Guest Registry: When you visit a sales center, and complete a registration/Guest Registry form or through your interaction with a Mattamy New Home Counselor/Sales Agent, we may collect certain personal information such as your first and last name, mailing address, email address, and phone number (including information you choose to provide optionally, such as desired features and upgrades for your home, the number of household occupants, and other information). The information you provide is used to better understand your needs, assist you in finding a suitable home and to send you tailored communications about Mattamy's homes, products, and Services.

 

  • Purchasing a Home: When you purchase a home, we collect personal information:
    • when you complete an Agreement of Purchase and Sale for a residential property, including the name and contact information (such as email address, mailing address, and telephone numbers) for each purchaser and purchase amount, as well as your closing date, occupancy date, and copies of executed contracts, for the purposes of facilitating the residential property transaction. We may also collect date of birth, marital status, residency status, financial information, payment card information (such as credit/debit card information), social insurance number, and photographs or video recordings of your purchased home for this purpose;
    • if you use Docusign to execute an Agreement of Purchase and Sale or other relevant agreements, geolocation information will be collected as part of an audit trail to show the proper execution of the agreement;
    • when you provide your deposit for a purchase of residential property. 
    • to provide you with homeowner updates and the status of your new home construction;
    • to complete your requested home purchase, including working with your lender and settlement/title agent to finalize your loan; verify your identity by collecting valid government-issued identification such as your driver’s license;
    • to provide the master developer and applicable homeowners associations and/or condominium associations and community development districts or special districts, if applicable, and their agents information concerning you and your home purchase;
    • when you register for a new home warranty plan or when you make a warranty customer care request;
    • to provide you with customer satisfaction surveys; and
    • to manage your relationship with Mattamy.


  • Website Registration: We may require you to register for access to certain information, products, and Services on our Website. At such time, we may request certain personal information such as your name, mailing address, telephone number, and email address.

 

  • Marketing Communications: When you purchase a home, complete a Guest Registry form or otherwise sign up to receive marketing communications, we may use your contact information to send you tailored communications about our homes, communities, products, Services, and promotions.  We may also send you information about products and Services of third parties that may be of interest to you, to the extent permitted by applicable laws.

    You can opt-out of receiving future marketing and promotional communications at any time by clicking on the unsubscribe link included in our email communications, visiting our Preference Centre, or by contacting us as set forth in the Contact Us section below. 

    We may also use services provided by third-party platforms (such as social media, Google, and other websites) to serve targeted advertisements on such platforms to you or others, and we may provide a hashed version of your email address and other personal information about you to the platform provider for such purposes. For clarity, the information we share with such providers may be used to deliver targeted advertising to you as well as to identify other potential customers whose profiles and online activities are similar to yours, in order to deliver Mattamy ads to such third parties. The platform providers may also use the information they collect regarding engagement with such ads for their own purposes.     If you visit a third-party website and sign-up to be contacted by a homebuilder, regarding the construction of a new community, we may collect your name, phone number, and email address from the third-party operating the website to contact you regarding your interest in a Mattamy home. The third-party websites that you visit have their own separate and independent privacy policies, notices, and terms of use, which we recommend you review carefully.

  • Survey and Customer Research: From time to time, we (or a third party on our behalf) may offer you the opportunity to participate in one of our surveys or customer research. The information obtained through our surveys and customer research is used in an aggregated, non-personally identifiable form to help us understand our customers and to improve our Services, marketing, customer service, and products. In addition, we may analyze call recordings and transcripts to evaluate and improve our customer services, including to identify emerging trends or systemic issues (e.g., to understand customer sentiment and pain points by analyzing tone, keywords, or themes across calls) as well as to track responsiveness and efficiency of our personnel (e.g., by measuring things like hold times and how quickly customer issues are escalated or resolved).

AT Pixel

Pixels are tiny invisible images or snippets of code that load when you visit a webpage. When the pixel loads, it allows our advertising partners to recognize your browser, understand how you interact with our site and connect that activity with other information that helps us deliver more useful content and ads.

We specifically utilize the Audience Town (AT) Pixel to track device and browser details, website activity, your general location and work in concert with cookies to help us with our advertising campaigns.

The personal information collected from you is used for specific purposes, as described in this Privacy Notice (including as described below and under “How Does Mattamy Collect Your Information) or when we collect your personal information. 


The personal information collected from you is used to improve customer service and support services, to personalize users’ experience, to improve the Services, to process payments or refunds, to send regular e-mails, to conduct contests, surveys, promotions, to analyze customer behaviours and generate customer insights, for marketing purposes, or for any additional purpose specified at the time of collection of the information. 

 

Your personal information will also be used for any purpose reasonably necessary to provide the Services. If you purchase a Mattamy home, this includes using your information to: verify your identity; facilitate the residential property transaction; provide construction and homeowner updates; facilitate the installation, activation and functioning of telecommunication, utility monitoring, smart home, water heating and HVAC equipment, as well as payments for such equipment; complete the home purchase, including working with your lender, solicitor and mortgage agent to finalize loans; coordinate with the master developer and applicable homeowners associations and/or condominium corporations and their agents; register you for and administer a new home warranty plan, and respond to warranty requests; and otherwise communicate with you and manage our relationship with you.


Your personal information will be kept confidential and will not be used for other purpose except as specified in this Privacy Notice or otherwise described to you. We may use some or all of your personal information to facilitate a corporate divestiture or dissolution, or as otherwise required or permitted by law.

Veteran or military status is only used to determine eligibility for VA financing.
Geolocation Data. This is information that reveals your physical location. We collect this information via the Docusign platform when you execute agreements with us through the Docusign platform. This information is collected as part of an audit trail to show the proper execution of the agreement through Docusign. You can opt out of Docusign collecting your Geolocation data.
Commercial information. Records of services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We also collect this information when you enter into an agreement with us. We collect this information to create a record of our transaction with you.
Internet or other similar network activity. Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement. We collect this information from you when you use our website through cookies, third party scripts and other tracking technologies. To provide you targeted advertising, running promotions, improving your customer experience and better developing the Service and our offerings.
Professional or employment related information. Current or past job history. We collect this information from you as part of the home-buying process. This information is used to help Mattamy understand its customers for its marketing.
Other information collected about homebuyers. Date of birth, marital status, residency status, financial information, payment card information (such as credit/debit card information), social insurance number (for Canadian Consumers), and photographs or video recordings of your purchased home. This is collected by us as part of the home sale process. Date of birth, marital status, residency status, financial information and social insurance number (for Canadian consumers) are all collected as part of the purchasing process.
Photographs and video recordings of homes are collected from purchasers/purchasers. We need to market the home before it is sold to you, record the condition and appearance of the home at sale, and condition and appearance for purposes of warranty work.
Sensitive Personal Identifiers. Anything that reveals your driver's license, state identification card, or passport number. Information like driver's license numbers, Social Insurance Numbers (for Canadian purchasers) or passport numbers are collected as required in the transaction to verify your identity. Information like driver's license numbers or passport numbers are used to verify your identity.
Sensitive Personal Account Information. Anything that reveals your account log-In, passwords, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account. This may also include geolocation data if you are in a remote or sparsely populated area. We collect this information when you enter into an agreement with us. Information like credit card numbers, debit card numbers, or other financial information is only collected as part of a transaction.
We collect Geolocation Data via the Docusign platform when you execute agreements with us through the Docusign platform.

HOW WE MAY SHARE PERSONAL INFORMATION

If you purchase a Mattamy home, we may share your information with lenders and their legal counsel, real estate agents and brokers, Tarion and the Home Construction Regulatory Authority, third parties that provide services to the property (e.g., suppliers of smart home technology, security systems, telephone, cable, internet and other telecommunications, utility monitoring systems, water heater rental, HVAC rental, and other services or utilities), insurance companies (including title insurance companies), third parties providing labour or materials for the construction of the property, legal counsel, governmental authorities, service providers and affiliates (as described further below), and other persons with your consent.

To the extent permitted by law, your Personal Information that we collect when you purchase or use the Service may also be shared with the following categories of third parties:

  • Service Providers: Your personal information may be shared with (or otherwise made available) to our affiliates and other third parties who provide services on our behalf. For example, we use service providers to provide services such as maintaining our Website, hosting our job application form, providing services related to our Website, collecting and analyzing customer satisfaction data, performing warranty work on homes, and sending electronic mail or other functions related to our business and services. We may also engage other types of service providers, as needed or helpful, in order to achieve our purposes for collecting personal information as described in this Privacy Notice. You may contact us for more information on our service providers, as set out below under “Contact Us”. Our service providers are given the information they need to perform their designated functions and are not generally authorized to use or disclose personal information for their own marketing or other purposes. However, service providers that send, administer, or analyze customer surveys are permitted to use, transfer, disclose, and sell aggregated and de-identified information for their own purposes, provided that they take steps to ensure that individual customers cannot be identified through the use of that data.

We may share your personal information with our affiliated companies, including Mattamy Home Funding, LLC℠, Mattamy Homes Title Agency, LLC, Mattamy Homes Insurance Agency, LLC, so that they may provide you with information on the products and services they make available to our homebuyers.

  • Third Party Marketing: After you have executed a purchase contract, we may share your personal information with third parties that have a product, service, or other marketing information that we believe may be of interest to you as a home buyer, such as your name, address, telephone number, postal address, and e-mail address with these companies in an effort to help you find these resources. These companies may include one or more telecommunications companies, gas companies, and utility providers who serve the community, and subcontractors who have worked on your home so that they may provide you with information on extended service or warranty plans or monitoring or maintenance services they may offer.  You have the opportunity to “opt-out” of having this personal information shared for marketing purposes with third parties at any time. You may opt-out or change your previous election by sending a request using any of the methods set forth in the Contact Us section below.
  • Third Party Platforms: As described under “How Does Mattamy Collect Your Information”, we may provide a hashed version of your email address and other personal information about you to third-party platform providers for the purposes or delivering targeted ads to you. These third parties may also use such information to generate new leads for us, including to identify potential customers whose profiles and online activities are similar to yours and deliver ads to such persons. The platform providers may also use the information they collect regarding engagement with such ads for their own purposes. To opt-out of Mattamy’s sharing of your information for such purposes, please send a request using any of the methods set forth in the Contact Us section below.
  • Developers: After you have visited or expressed interest in a particular community, we may share your visitor information with the master developer of that community.
  • Sale of Business: We may disclose your personal information to third parties in connection with financing that we seek or in connection with a prospective or completed business transaction, including a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of Mattamy or as part of a corporate reorganization or stock sale or other change in corporate control.
  • Legal/Compliance: Mattamy, its affiliated companies, and its Canadian, U.S., and other foreign service providers may provide your personal information in response to a search warrant, judicial process, subpoena, or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise required or permitted by applicable Canadian, U.S., or other law. Your personal information may also be disclosed where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.
  • Other: Mattamy may also disclose personal information about you as required or permitted by law, including for such purposes as resolving consumer disputes or inquiries and reporting to consumer reporting agencies.

Your personal information may be maintained and processed by us, our affiliates, and other third-party service providers in Canada, the U.S., or other jurisdictions. In the event personal information is transferred to the U.S. or other foreign jurisdiction, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts (or related parties), law enforcement, and governmental authorities in accordance with those laws. If you are located in Canada, you may contact our General Counsel as described below under “Contact Us,” to obtain written information about our policies and practices with respect to service providers (including affiliates) outside Canada, or to ask questions about the collection, use, disclosure, or storage of personal information by such service providers and affiliates outside Canada.

Driver's licenses and passport numbers are only shared as required to complete our transaction with you.

In the event we share your name mailing address, and email address for Google's Customer Match advertisement pertaining to Mattamy.

Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). A name, address, telephone number, credit card number, debit card number, or any other financial information. Protected classification characteristics under California or federal law. Veteran or military status. This information is shared with your mortgage provider. This information is shared to determine eligibility for VA financing.
Sensitive Personal Identifiers. Anything that reveals your driver's license, state identification card, or passport number. This information is only shared with the title company, your mortgage provider, and the title underwriter. This information is only shared as required in the transaction to verify your identity.
Sensitive Personal Account Information. Anything that reveals your account log-In, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account. This information is only shared with the title company, your mortgage provider, and the title underwriter. Information like credit card numbers, debit card numbers, or other financial information is shared as required to complete our transaction with you. Some financial information about you may be shared to help determine availability for affordable housing, as verification is required.

 

 

User Generated Content

In addition to the above, Mattamy engages a service provider to identify social media postings related to Mattamy properties. Mattamy or its service provider may repost / republish such social media postings, including photographs, with the user’s consent. Prior to granting consent for Mattamy to repost / republish your content, you are responsible for obtaining valid consent from any third party whose personal information is contained in your posting. Your social media postings will be used and publicly disclosed (including via publication online) by Mattamy and/or its service provider for the purposes of promoting and marketing Mattamy’s products and services. Unknown third parties may have the ability to download, copy, use, republish and make comments on such postings (including any personal information contained therein) without moderation, and Mattamy may not be able to control further dissemination of the information even if you withdraw consent for Mattamy to continue using and disclosing the information. Our Website may contain links to other sites that we do not own or operate, including social media websites. HOW DOES MATTAMY PROTECT YOUR INFORMATION?

 

Data Storage and Retention

We retain personal information for as long as we reasonably require it for legal or business purposes. Mattamy has personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated in the Privacy Notice (or as described to you at the time of collection) or to otherwise meet legal, auditing or compliance requirements.

To determine how long we may retain your information, we consider: (1) whether we have an ongoing relationship with you (e.g. we do not generally delete your information while we're actively helping you with your home); (2) whether you'd expect us to keep your information unless you ask for it to be deleted (e.g. we won't delete your information if you're still under warranty); (3) whether there's a legal obligation to hold onto your information or keep a record; or (4) whether we need your information to be ready for a potential dispute with you or regulators. 

 

Security

As the first line of defense against unwanted intrusions against your personal information, we limit the collection of your personal information as described in the Privacy Notice. We utilize reasonable and appropriate protections and procedural safeguards to prevent misuse or unauthorized disclosure of personal information in our care. We take steps to restrict access to personal information to Mattamy employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Services.

If we learn of a security system breach, we may attempt to notify you, including electronically, so that you can take appropriate protective steps.   To the extent applicable law allows for such notification via email or posting on the Services, you agree to accept notice in that form. 
 
By using the Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. Your State Privacy Rights

Right to Know or Access: You may have the right to obtain confirmation about whether or not your personal information is being processed by us. If so, you may have the right to access the personal information we hold about you (including the specific pieces of personal information) and/or request other related information, such as the purposes for which use that information, the categories of personal information we process about you, the categories of recipients to whom your personal information has been or will be disclosed, the retention period for such personal information, or, if not possible, the criteria used to determine that period, your legal rights with respect to your personal information, etc.

Right to Delete: You may have the right to request the deletion of your personal information, except under certain circumstances subject to applicable law.

Right to Correct: Depending on your location and applicable laws, you may have the right to correct or update your personal information if inaccurate.

Right to Opt-out of Sale, Sharing, and Targeted Advertising of your Personal Information: You may have the right to opt-out of the sale of your personal information to third parties. You may also have the right to opt out of the processing of your personal information for the purposes of targeted advertising.
Right to Revoke or Withdraw Consent: You may have the right to withdraw consent to the continued use or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice.

Right to Nondiscrimination: You may have the right to non-discrimination, such as to receive equal service and pricing from a business, even after exercising your rights. 

Right to Data Portability: Depending on applicable laws, you may have the right to receive the personal information that you have given us and that we are processing, in a structured, commonly used and machine-readable format. You may also have the right to send that personal information to another controller.

Right to Opt-out of Profiling: You may have the right not to be subject to a decision based solely on profiling or automated decision-making.

Right to Limit the Use and Disclosure of Sensitive Personal Information: You may have the right to limit the use and disclosure of your sensitive personal information if we use such information to infer characteristics about you; however, we do not disclose your Sensitive personal information except to complete a transaction with you as required by law. 

Exercising Your Rights / Verifiable Consumer Request. To submit such a request, please contact us by email at privacy@mattamycorp.com or by mail at one of the addresses below. Please note that we may continue to share your personal information with our affiliates and service providers, for essential purposes described above and other such circumstances.

Verification. We cannot respond to your request or provide you with personal information unless we can verify your identity and your authority to make the request and confirm that the personal information relates to you. A verifiable consumer privacy request must:

  • provide sufficient information that allows us to reasonably verify you are the person about whom we have collected personal information or an authorized representative;
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Authorized Agent. If you are a resident of California you may, under certain circumstances, authorize another individual or a business, called an Authorized Agent, to make requests on your behalf. If you wish to have an Authorized Agent make a verifiable consumer request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information. 

Responding to Your Request. It is our goal to respond to your request within 45 days of receiving that request. If we require more time or are unable to comply with your request, we will inform you of the reason and inform you of the extension period for completion in writing. Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response.
We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Appeals. Residents of California, Texas, and Virginia have the right to appeal a denial of their request by contacting us as described in our notice of denial.

 

California “Shine the Light” Law

If a business shares “personal information” (as defined in California’s “Shine the Light” law, Cal. Civ. Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. We do not share your personal information with third parties for their direct marketing purposes.

 

Nevada Disclosure

Residents of Nevada have the right to opt out of the sale of certain personal information to third parties. We currently do not sell your personal information as defined by Nevada law. 

 

Your Canadian Privacy Rights

If you are located in Canada, you have the right to access and correct your personal information subject to certain required and permitted exceptions under applicable law. You may also have the right to:
  • be informed of the existence, use, and disclosure of your personal information, and  challenge the accuracy and completeness of it;
  • receive an account of the use that has been made or is being made of your personal information, including information about the purposes for which your information has been and is being used by Mattamy;
  • receive an account of the third parties to whom your personal information has been disclosed, including a list of organizations / persons to which Mattamy disclosed or may have disclosed your information, and information regarding the circumstances in which your information has been and is being disclosed to such persons; 
  • Ask questions about Mattamy’s collection of your personal information or Mattamy’s service providers outside Canada, and obtain written information regarding Mattamy’s policies and practices with respect to service providers outside Canada; and/or
  • Address a challenge concerning Mattamy’s compliance with applicable laws to our Privacy Office / General Counsel.

Mattamy will respond to requests by individuals in Canada to exercise their rights in accordance with the relevant law(s). Nothing herein is intended to create any rights that do not exist under the applicable law in the jurisdiction where you are located.

 

Other International Visitors Privacy Rights

Mattamy builds homes and communities in certain States and Provinces in the United States and Canada, and we follow the relevant data protection and consumer protection laws of the United States and Canada and its individual states/provinces and territories. If you reside or are located in a different country (or in a province or State where we do not build homes and communities), the data protection laws of that country may differ as to protections under data protection laws in your country of residence.   The personal information you submit to Mattamy will be transferred to the United States, Canada or other foreign jurisdictions for the purposes described in this Privacy Notice.
 
If you request information regarding the personal information that we maintain about you, we will fulfill your request as required by applicable law. Note that if you consented to allow the disclosure of your personal information to a non-affiliated third party other than a Mattamy service provider, we will not be able to take any action with respect to personal information under the control of such third party and you will need to submit your request directly to that third party.
